  • One of the best options for defendants
  • After plaintiffs have made initial written allegations to the court, before the trial begins, defendants can argue case should be dismissed
    • either because plaintiff failed to make case (insufficient evidence of publication, identification, defamation, falsity, or requisite level of fault)
    • or because there is a legal defense to block suit
